Terms and Conditions

 

Please read these Terms and Conditions carefully before placing your order with Mulholland Interiors.  We accept your order on the basis that you have read, fully understood, and agreed to these Terms and Conditions. 1.        Quotation

1.1.        Our quotation will be prepared based upon communications between you and the interior designer and is valid for one month from the date of issue.

1.2.        Please ensure that you agree with the quote in full, as this will act as your order confirmation/deposit.

1.3.        It is the client's responsibility to ensure that the items listed in the quotation are correct and final. This is especially important when there have been numerous iterations of quotations shared.

1.4.        Please note that any images communicated are for illustrative purposes only and not necessarily in the model, colour, or finish shown.

1.5.        By accepting the quotation, you are confirming that you understand and agree to the terms and conditions within the document.

1.6.        Unless specific exclusions or variations are confirmed in writing, the terms and conditions in this document are binding.

 

2.        Changes and Variations

2.1.        In the event that the client requires any changes or variations to the initial quotation AFTER accepting the quotation, then the following procedure must be adopted:

2.2.        Please notify us via email if you require any changes within 3 working days of our quote being sent/emailed to you. We will use all reasonable endeavours to accommodate these. If we cannot, the original quotation will be adhered to.

2.3.        Should the quotation be altered, the client will be charged accordingly for any additional materials required. Any changes or variations instructed directly to any contractor or supplier will fall outside of the contract with Mulholland Interiors.

2.4.        We will notify you of the costs for any changes or variations within our invoice. No additional work which increases the cost of the quotation will be undertaken until payment has been made pursuant to these Terms and Conditions.

 

3.        Other Fees

3.1.        All on-site consultations will be charged at a fee of R950 per hour plus VAT

3.2.        In addition to on-site consultations, all time spent on creating the design concept will be charged at R950 per hour plus VAT.

3.3.        In the event that Mulholland Interiors is expressly appointed in writing to coordinate third-party contractors and suppliers, a project management fee of 10% of the total contractor and supplier value will apply. Unless such an appointment is confirmed in writing, Mulholland Interiors shall be deemed to have acted only as a design consultant.

3.4.        The design fee will be added to each invoice during the project unless an alternative agreement was made in writing. 

3.5.        Should the project be cancelled, a 20% cancellation fee will be charged, i.e 20% of the total quotation. A project is considered to have started once payment of the deposit has been made.

3.6.        Payment is required in full upon completion of each phase of the project, and payment needs to be made in full prior to delivery.

3.7.        We reserve the right to charge for delivery fees, installation fees, and storage fees.

3.8.        Storage fees may be charged if the client delays their project and it is necessary for Mulholland Interiors to store the goods beyond the original agreed date.

3.9.        Installation fees that have been quoted are subject to final inspection done on site by the installer and can vary in the event where extras have not been accounted for.

3.10.        Additional charges, such as call-out fees, may apply should the client cancel appointments last minute (less than 3 hours prior to the appointment)

 

4.        Third-Party Contractors & Suppliers

4.1  Mulholland Interiors may, at the client’s request, recommend or provide the contact details of third-party contractors, tradesmen, installers, suppliers, or service providers (“third-party contractors”) for the client’s consideration.

4.2  Where possible, Mulholland Interiors will endeavour to provide the client with at least two contractor options and/or quotations for comparison. The final selection of the contractor rests solely with the client.

4.3  Any agreement for services, including but not limited to quotations, scope of work, pricing, deposits, payment schedules, workmanship, delays, defects, damages, non-performance or incomplete work, shall be solely between the client and the third-party contractor.

4.4  Mulholland Interiors acts only as a referrer unless expressly appointed in writing to manage or coordinate the contractor. The introduction or recommendation of a contractor shall not constitute a warranty, guarantee, endorsement, supervision, or acceptance of responsibility for that contractor’s work.

4.5  Mulholland Interiors shall not be liable for any act, omission, delay, defective workmanship, overcharging, incomplete work, abandonment of site, damages, losses, or disputes arising from any third-party contractor introduced or recommended to the client.

4.6  Where Mulholland Interiors has been expressly appointed in writing to coordinate or manage a third-party contractor, Mulholland Interiors’ responsibility shall be limited to reasonable coordination only and shall not extend to guaranteeing the contractor’s workmanship, pricing, timing, or completion of the work.

4.7  Any instructions, changes, or variations given directly by the client to a third-party contractor fall outside of Mulholland Interiors’ scope and responsibility.

4.8  The client remains solely responsible for reviewing and approving all quotations, scope of work, payment schedules, and invoices issued by any third-party contractor prior to making pay

 

5.        Payment Terms

5.1.        A deposit will be required upon placing the order. Once the deposit has been paid, manufacturing and ordering of materials will commence.

5.2.        A final settlement of the balance is due before delivery and upon completion of the items.

5.3.        In the event that a change, variation, or delay has been made pursuant to the clauses above, payment must be made within 7 days of issue of the invoice in this regard. Any amounts paid are non-refundable under any circumstances.

5.4.        On larger orders/projects, Mulholland Interiors will issue invoices for various stages of the project.

 

6.        Retention of Title

6.1.        Ownership of any goods shall remain the property of Mulholland Interiors and may not pass to the client until these goods have been paid for in full.

 

7.        Delivery

7.1.        Every effort will be made to deliver the goods on time.

7.2.        Under no circumstances will refunds be given if delays beyond our control are incurred.

7.3.        Please ensure that all access information, e.g., Gate codes, alarm codes, door codes etc., is given before delivery and that access is clear and safe for delivery.

7.4.        Please ensure that a responsible party is on site to accept and inspect the delivery of the items. 

7.5.        Any defects, damages, or shortfalls must be reported to Mulholland Interiors in writing within 24 hours of delivery. Mulholland Interiors will not be held responsible for any defect or damages reported 24 hours after the delivery.

7.6.        Mulholland Interiors requires 24 working hours’ notice to rearrange a delivery. We may charge a cancellation fee if we are not given this notice, or for a failed delivery on an agreed delivery date if the client or a responsible party is unavailable to accept goods.

7.7.        Mulholland Interiors will not be held responsible for the delay in delivery in the event where the suppliers are out of stock or have a backlog.

7.8.        While Mulholland Interiors may arrange and/or include delivery services in our quotations, all liability for damage to client property during delivery remains solely with the transport company or delivery subcontractor. By accepting these terms, the client acknowledges that Mulholland Interiors' responsibility is limited to arranging the delivery service only, and any claims for property damage during delivery must be addressed directly with the transport company. Mulholland Interiors may, at its discretion, assist in facilitating communication between the client and transport company, but assumes no liability or responsibility for property damage occurring during delivery, including but not limited to damage to walls, ceilings, floors, doorways, or other structural elements of the premises, as well as any damage to the purchased items themselves during transit and delivery.

 

8.        Storage

8.1.        Once goods arrive at our storage location, they will be made ready for collection or delivered on a mutually convenient date, within 2 weeks, and once payment has been received.

8.2.        If the client is unable to take delivery for any reason within these two weeks, then we reserve the right to charge a storage fee of R500 ex vat per week, depending on the number of items and storage space utilised.

8.3.        Mulholland Interiors does not accept liability for insurance after the initial 2-week period.

8.4.        If goods have not been collected within 6 months after the initial 2-week period, the goods will be sold.

 

 

9.        Specification and Colour

9.1.        All images shown on our website and brochure are for reference only, and exact shades of wood, leather, fabrics, and other natural products cannot be guaranteed. Wood is a natural product, and therefore, slight movement and variation in colour and grain can occur. Samples should be regarded as an approximate representation only. If you have any questions relating to any products being used or characteristics, please raise this with the interior designer.

9.2.        All fabrics/carpets are susceptible to fading if exposed to strong or natural light for prolonged periods. Where fabrics are subject to variations in atmospheric conditions, shrinkage and/or dropping may occur, for which we accept no responsibility.

9.3.        While every effort is made to ensure that the product you buy, including timber, fabric, and leather products, corresponds as closely as possible to the sample shown in our store or on our website, slight differences may occur. We regret that no responsibility can be accepted for variations which add to the unique characteristics of Mulholland Interiors products.

 

10.        Refunds/Exchanges

10.1.        We do not offer refunds. No refunds for custom-built items (including woodwork, consoles, coffee tables, dining tables, couches/armchairs, or any furniture that has been built using wood, stone/marble/granite, steel, and powder-coated or painted for the customer) that have been cut to your requirements.

10.2.        Mulholland Interiors products are made to order and custom-made, especially for you; therefore, no exchanges or returns will be permitted unless the goods are defective. We will work to rectify any defects with your order.

10.3.        Kindly note that items are built upon order; we do not keep stock.

 

 

11.        Liability

11.1.        Mulholland Interiors excludes all liability and responsibility for any loss or damage that may result to you, your property, or a third party in connection with the supply, delivery, and installation of goods. This specifically includes, but is not limited to, any damage caused by third-party transport companies or subcontractors during delivery, whether to the client's property, fixtures, walls, ceilings, floors, or any other part of the premises.

11.2.        A warranty is only enforceable on products manufactured by Mulholland Interiors directly for a period of 6 months from the date of completion and excludes mechanical damage or unreasonable wear and tear, provided:

                         11.2.1.        The goods concerned have been used for the purpose intended and in a domestic environment unless otherwise waived in writing

                         11.2.2.        The customer has cared for the good in line with the care instructions communicated

                         11.2.3.        The goods have not been damaged as a result of misuse, neglect, abuse, or unauthorised modifications by the customer

                         11.2.4.         The goods have not been altered in any manner or partially disassembled by the customer

12.        Use of Information

12.1.        All scheme designs generated by us remain the property of Mulholland Interiors. By allowing Mulholland Interiors to photograph its project at your property/project location you agree to allow Mulholland Interiors to use the photographic image for promotional purposes.

12.2.        Client testimonials’ may be used by Mulholland Interiors for promotional purposes.

 

13.        Copyright

13.1.        All proposals and designs supplied by Mulholland Interiors are copyrighted and are the property of Mulholland Interiors and cannot be used for redistribution.

13.2.        In the event where designs/proposals have been used for redistribution/manufacturing without Mulholland Interiors written consent, a penalty fee of 30% of the product/service value will be charged.
